TERMS AND CONDITIONS

1.  Definitions

1.1. The Company: References to 'The Company' in each dealings will include The Company (Millway Heating And Plumbing), The Companies agents and employees.

1.2. Variations: This includes omissions, additions or substitutions and changes to the originally agreed work. Example being fittings and fixings etc.

1.3. Central Heating system: this means the central heating system at the property which includes but not limited to:

A. The boiler

B. All controls (clocks, thermostat, diverter valves, radiator valves, trv's, pumps, smart controls etc)

C. All pipework, valves, hot water cylinders, radiators and the feed and expansion tank.

2.  Payments

2.1. Payment types we accept are

       A- Bank transfer

       B- Cash 

       C- Debit and Credit cards

2.2. Unless payment terms are agreed before any commencement of work, all payments will need to be made on the day of works completion.

2.3. All goods and materials supplied by The Company will remain the ownership of The company until the customer has paid the invoice in full.

3.  Quotations

3.1. Each and every quotation will be provided by The Company based on information provided to The Company by the customer. Any variations that are required following the quotation and before work commences will result in a revised quotation being raised for the customer to accept.

3.2.  If any variations are required after work has commenced, a fixed price to cover the variation will be agreed between The company and the customer and added to the final invoice.

3.3. If in the event requirements change due to insufficient information having been provided and faults and defects are found in the existing central heating system, the customer would be liable for all additional expenses incurred.

4.  Estimates

4.1. The Company will provide estimates on a best endeavour basis only and unless a fixed price quotation has been provided to the customer before any work commences, work shall be charged by the hour or part thereof and may include time taken to research, source and purchase/collect any materials provided.

5.  Unforseen Costs

5.1. It will be the responsibility of the customer to meet the cost of all additional work, fittings or services that are required to rectify any event or situation which occurs during the course of the works that are unexpected or are beyond the control of The company. The company will not be held responsible for any such event or situation.

6.  Liability

6.1. The Company shall only be held responsible for the extent of works carried out by The Company. The Company accepts no liability in respect of any defects found in the existing central heating system or in respect of parts not manufactured by The Company.

6.2. The Company shall not be held responsible for any and all loss or damage to property, materials or injuries to individuals caused by the personal actions of the customer or any other household member or guests, before, during and after such works have been carried out.

6.3. The advice provided by The Company will be and is offered as an opinion only. The customer accepts such opinions at the their sole discretion and risk. The customer employs the services of The Company at the customers sole risk at all times.

7.  Health and Safety

7.1. The company will take the appropriate and practical measures to ensure that the environment where works are being undertaken is safe to avoid risk of injury to The Company or other parties and The Company expects the customer to do the same. Outside of work hours, where work is ongoing, The Company will accept no liability for any action of the customer or other household members or guests, which result in damage or injury to Persons or property.

7.2. The Company reserves the right to refuse to undertake work at all times regardless of the situation. 

7.3. If the customer is concerned about any situation, property, equipment or materials that they think  to be unsafe they must talk to The Company immediately.

7.4. If any substance hazardous to health is discovered on site, which is covered by Control of Substances Hazardous to Health (COSHH) regulations, The Company will inform the customer and The Company has the right to cease work in all situations until the substance has been removed and disposed of in compliance with the relevant legislation. All costs for removal and disposal shall be met by the customer.

8.  Duty of care

8.1. The Company accepts that it has a duty of care to the customer in respect of materials, workmanship, security, property and belongings. Therefore The Company will conduct its business in a way that a reasonable level of care is provided.

9.  Building Regulations

9.1. The company has the right to refuse to carry out or commence all works which is in breach of the relevant Building Regulations or which it believes to be in breach of the Building Regulations or the spirit in which they are intended.

10.  Services and Waste

10.1. The customer is expected to provide access to sanitary conveniences for The Company whilst work is being undertaken. The customer shall pay for and provide all power and water reasonably used by The Company during work being undertaken.

10.2. Unless a different arrangement is agreed before the commencement of any work, waste removal and disposal will be organised by and at the cost of the customer.

11.  Powerflush

11.1. Before carrying out the Powerflush, The Company will use all reasonable endeavours to advise the customer of any deficiences with your central heating system that could cause the fault with your central heating system to return once the Powerflush has been undertaken. In this scenario The Company will provide a quote to carry out any additional work that may be required. If following the quote you decline to have the necessary additional work carried out, The Company has the right to cancel the contract and you will pay The Company any costs that The Company incurred in connection with the contract, which The Company have the right to invoice you for.

11.2. The Company will use all reasonable endeavours to find any problems with your central heating system before The Company commences with the Powerflush. The Company cannot be held responsible for any damage caused by the Powerflush to the customers central heating system as a result of any defects/faults/wear and tear on any part of the central heating system or pin holes in radiators/pipework or any part of the central heating system caused by external or internal corrosion that The Company could not have reasonably identified before the Powerflush commenced.

11.3. If following the Powerflush being completed The Company is of the opinion that a further Powerflush is required a quote will be provided for the additional Powerflush and work.

11.4. Following the successful completion of the Powerflush The company will supply a Powerflush certificate to the customer.
